How to check this page

  1. Every rule quotes a saved copy of an official page, word for word. The SHA-256 under each source is the fingerprint of that saved copy, so anyone can confirm the text has not changed.
  2. A checker keeps a rule only if its quote matches the saved text and every number in the rule appears in the quote.
  3. A normalizer turns the rules into the law IR. Rules about someone other than the survivor, or with nothing to compute, are set aside with a reason.

No minimum dollar loss was found in the statute or on CalVCB pages; Gov. Code 13955(g) only requires that the injury has resulted or may result in pecuniary loss. Lost income has no separate dollar cap in the sources read (it is limited by time, generally five years, in Gov. Code 13957.5 and by the overall total). No mileage rate was found. Medical is paid at board rates (Medicare rate or 75% of billed per the What Is Covered page) rather than a fixed dollar cap. Emergency awards have no fixed dollar amount; Gov. Code 13952.5(g) ties the amount to the immediate needs of the victim, subject to board rates and limits. Whether the survivor's health insurance may be billed for the forensic exam is not addressed in Penal Code 13823.95, so insurance_billing is left unspecified. No California statute was found that makes the whole CalVCB claim file confidential or exempt from the Public Records Act; the record_confidentiality rule rests on CalVCB's own Confidentiality page (CA-S21). Gov. Code 13954 only bars the board and victim centers from disclosing documents that personally identify a minor, and that section was not saved.

Costs incurred by a qualified health care professional, hospital, clinic, sexual assault forensic examination team, or other emergency medical facility for a medical evidentiary examination of a victim of a sexual assault, as described in the protocol developed pursuant to Section 13823.5, when the examination is performed pursuant to Sections 13823.5 and 13823.7, shall not be charged directly or indirectly to the victim of the assault.

Reporting to police

A sexual assault claim cannot be denied only because no police report was made; medical records, mental health records, or a sexual assault exam can show the crime happened.

An application for a claim based on a sexual assault shall not be denied solely because a police report was not made by the victim. The board shall adopt guidelines that allow it to consider and approve applications for assistance based on a sexual assault relying upon evidence other than a police report to establish that a sexual assault crime has occurred. Factors evidencing that a sexual assault crime has occurred may include, but are not limited to, medical records documenting injuries consistent with allegations of sexual assault, mental health records, or that the victim received a sexual assault examination.

Gov. Code 13956, 13957, and 13957.5 each have two versions on leginfo: the version quoted here (total award $35,000, raisable to $70,000 with federal funds; relocation $3,418) and an alternate version (AB 160 of 2022 and AB 1187 of 2023) with a $100,000 total, $7,500 relocation, and no dollar cap on victim counseling that only becomes operative July 1, 2024 if General Fund money is appropriated to backfill the Restitution Fund.
