Statute text is from Justia's 2025 Indiana Code (the official iga.in.gov code viewer is a script app); the administrative rule is from the official Indiana Administrative Register. Conflicts, statute wins in the rules: (1) Filing deadline: IC 5-2-6.1-16(b) requires the application within 180 days of the crime, extendable for good cause to no more than two years; the program page says applications must be filed no later than two years after the crime. (2) Total cap: IC 5-2-6.1-35 caps an award at $15,000; the FAQ describes $20,000 total ($15,000 plus an additional $5,000 for funeral costs). Funeral costs up to $5,000 are a listed expense in IC 5-2-6.1-21.1(d)(6). (3) Medical expense window: IC 5-2-6.1-21.1(d) covers expenses incurred within 180 days, extendable to two years; the program page says medical expenses must be incurred within two years. (4) The application form State Form 23776 (R14 / 9-21) predates the 2022 changes: it lists a 180-day deadline and a 72-hour report with no sexual assault exam alternative. (5) 203 IAC 1 (readopted 2023) still contains older figures superseded by statute: a 48-hour reporting rule, a $4,000 funeral cap, $1,000 or $1,500 counseling caps, and a 48-hour report condition for sex crime ER payment; it also says a provider may bill the patient or a collateral source if fund payment is denied (203 IAC 1-2-1(c)), which conflicts with IC 16-21-8-6(f) and IC 16-21-8-1(a) (exam services may not depend on reporting to or cooperating with law enforcement). Only the $500 emergency award is taken from 203 IAC 1, since no statute addresses emergency awards; the FAQ confirms emergency funding exists and that an application must be filed first. (6) The program page says crimes outside Indiana are not eligible; IC 5-2-6.1-12(a)(1)(B) lets Indiana residents apply for crimes in places without a substantially similar program. Other: victims of a child sex crime may apply until age 31 (IC 5-2-6.1-16(e)) and are exempt from the 72-hour report rule (IC 5-2-6.1-17(a)). IC 5-2-6.1-21.1(f) bars a health care provider that accepts division payment from charging the victim a copayment. Bodily injury includes emotional trauma that stems directly from a physical impairment, visible injury, or physical pain (IC 5-2-6.1-0.5). Reviewer additions: 203 IAC 1-1-9(d) also says the total award may not exceed $15,000 per victim, which agrees with IC 5-2-6.1-35 against the FAQ's $20,000. IC 16-21-8-5(b) conditions payment for additional forensic services (not the exam itself) on the victim being 18 or older or, for a minor, a report to child protective services or law enforcement, the crime occurring in Indiana, and the provider starting the claim in the division's web system. IC 5-2-6.1-16(g) gives victims of battery on a child under 14 five years to apply. A Spanish application is linked from the program page but not saved. Privacy additions: the Address Confidentiality Program is run by the Office of the Indiana Attorney General (IN-S23). The page says survivors of sexual assault are eligible ('Survivors of domestic violence, sexual assault, stalking, human trafficking, harassment, intimidation and invasion of privacy who fear for their safety are eligible for the ACP'); the quoted sentence in the rule has a missing comma after 'sexual assault' on the page itself. Mail goes to a substitute address and is forwarded, and the substitute address is used for driver's license, vehicle, voter, and school registrations and legal process. The application must be signed by a trained victim advocate. Record confidentiality rests on IC 5-2-6.1-11.5 (IN-S25), which makes a claimant's personal information and medical records confidential; the program FAQ (IN-S2) adds that information is given only to the legal applicant unless the victim or claimant gives written authorization to speak to a third party.
