How to check this page

  1. Every rule quotes a saved copy of an official page, word for word. The SHA-256 under each source is the fingerprint of that saved copy, so anyone can confirm the text has not changed.
  2. A checker keeps a rule only if its quote matches the saved text and every number in the rule appears in the quote.
  3. A normalizer turns the rules into the law IR. Rules about someone other than the survivor, or with nothing to compute, are set aside with a reason.

I found no minimum loss rule in the statute, the LAC rules, or the program pages. Nothing I saved covers home security devices or lock changes. Lost wages are paid at 80 percent of the gross weekly wage with no separate dollar cap I could find. Mileage is paid at the state travel rate, which is not stated as a number in the rule. Medical bills have no separate dollar cap beyond the $15,000 total; the board pays up to 70 percent of unpaid balances. The insurance_billing value for the exam is prohibited only in the program's provider instructions (LA-S3); the statute itself says the survivor cannot be billed directly or indirectly and does not mention insurance. Reviewer: the LAC 22:XIII.503(F) ambulance limits ($300 ground, $500 air) exist but are not encoded as a transportation cap, since ambulance is billed as medical. Record confidentiality: I found no statute or rule that makes the compensation board's claim files as a whole confidential or exempt from the Public Records Law. The rule I encoded is La. R.S. 46:1844(W), which bars public agencies, naming the board, from publicly disclosing the name, address, contact information, or identity of sex offense victims; it protects identity, not the whole claim file.

How the program reviews a claim

The board may deny or reduce an award because of the victim's conduct. The current statute says the behavior-based reduction does not apply when the injury came from a sexually oriented criminal offense.

Big change: Acts 2026, No. 684 (HB 969, signed by the Governor, effective Aug. 1, 2026 per the Resume Digest) rewrote La. R.S. 46:1801 to 1822. It renamed the program from Crime Victims Reparations to Crime Victims' Compensation, moved the filing deadline from one year to three years from the date of the crime, rewrote 'reasonable documentation' (law enforcement report, court records, a healthcare provider attestation, or a forensic exam attestation), added sexually oriented criminal offenses to the covered crimes, kept the $15,000 cap ($25,000 for permanent and total disability) and the $1,000 emergency award, removed catastrophic property loss, and added temporary lodging or permanent relocation and clothing/bedding/evidence property to pecuniary loss. As of Oct 3, 2026 the legislature's Law.aspx pages and Justia (2025) still show the pre-Act text, so I quoted the enrolled Act (LA-S14) or its official Resume Digest (LA-S15). The enrolled Act PDF prints struck-through deletions inline in its extracted text, so I detected strikethrough lines with PyMuPDF and only quoted lines with no struck words; its text also carries line numbers, so Act quotes are one printed line each. Re-snapshot the codified statute once legis.la.gov updates. Stale official material that conflicts with the statute (statute wins): the program page (LA-S1), the application form (LA-S2, Feb 2025), and LAC 22:XIII (Feb 2025) still say one year to file; the program page still lists vacation and sick leave as sources that pay first, but Act 684 excludes vacation and sick leave from wage continuation collateral sources; the program page still mentions catastrophic property loss of a residence, which Act 684 removed; the application form says insurance must be billed first, but LAC 22:XIII.303(A)(5) lets sexual offense victims choose whether to use private insurance or Medicaid. Sexual assault specifics: under 46:1809(B)(3)(b) as amended, the no-award grounds for failing to cooperate with law enforcement or being the offender/accessory do not apply when the application results from a sexually oriented criminal offense; the behavior-based reduction in 46:1809(B)(4)(a) also does not apply to those victims. The pre-Act 46:1806(B)(2) sentence that sexual offense victims need not report to police was removed by Act 684; non-report applications now rely on the reasonable documentation list, and LAC 22:XIII.303(A)(2)(c) still says adult victims need not report. LAC 22:XIII.303(A)(1) says applications for adult sexual offense victims go straight to the board office instead of the parish sheriff. Forensic exam: 40:1216.1(A)(6) says the survivor cannot be billed directly or indirectly; the provider ($600) and facility ($1,000) are paid under 46:1822, which Act 684 changed so LCLE staff, not a board order, approve exam reimbursements within 30 days. Services outside the forensic exam itself (for example treatment of injuries) may be billed to the patient or insurance per LA-S3, and the survivor can then seek compensation for them. Under 40:1216.1(A)(1)(a), no hospital or provider may require a survivor to report to police to get care or evidence collection. HB 998 (2026), which would have allowed exam billing through the patient's insurance, did not pass. Reviewer (Oct 3): corrected the exam payment pinpoint to LAC 22:XIII.503(A)(3) (it was 501(B)(3)); moved the child care rule from a program-page list fragment to the amended statute 46:1802(16)(c); confirmed with PyMuPDF strike detection that the 3-year deadline, the board extension clause, the $15,000 cap line, the $1,000 emergency award line, (A)(3) of 46:1805 and the 46:1809(B)(3)(b) and (B)(4)(a) sexual offense exceptions are unstruck. Open points: the program page still says victims must cooperate fully with law enforcement, which 46:1809(B)(3)(b) no longer applies to sexual offense applications; the Act does not say whether the 3-year period reaches crimes committed before Aug. 1, 2026 whose 1-year period had already run; LAC 22:XIII.503(Q)(3) says a police or incident report should accompany a relocation claim, which may matter for survivors who did not report; LAC 22:XIII.301(A)(2)(b)(i) says insurance must be processed before mental health claims, which sits uneasily with the 303(A)(5) insurance choice for sexual offense claims; Act 684 also removed the board's permissive rulemaking power, so how long the Feb 2025 LAC rules stay in force is unclear. How to file (Oct 3): the application PDF (LA-S2, Feb 19, 2025, still the one linked from the Downloads page as of its Aug 2026 update) has no fillable fields, so it is printed and filled by hand. Mail is the only method I could confirm. LAC 22:XIII.303(A)(1) says applications may also be filed online at the board's website, but the CVC Claims page (LA-S16) lists CVC Online Applications as Coming Soon, so I did not add an online submission rule; recheck later. No email, fax, or in-person filing address is stated. Adult sexual offense applications go straight to the board office (P.O. Box 3133, Baton Rouge, LA 70821) rather than the parish sheriff. Required documents: the form's reasonable documentation list (police report, court records, sworn certifications) is the pre-Act version; I used the Act 684 Resume Digest list instead (law enforcement report, court records, a healthcare provider attestation, or a forensic exam attestation). The form's 'insurance must be billed before claims are submitted' line conflicts with LAC 22:XIII.303(A)(5) for sexual offense victims, so I did not add an insurance_statement document. The 30 to 45 day processing time is the program page's typical time for the sheriff's eligibility decision, not a payment deadline. Privacy additions (Oct 3, 2026): The Address Confidentiality Program is run by the Secretary of State under La. R.S. 44:51 to 57; the program page (LA-S17) and R.S. 44:52(A)(1) and (A)(3)(a) (LA-S18, Justia 2025 text) both say victims of sexual assault are eligible. The page also says applicants must have relocated to an address with no public record and must not own the home, and R.S. 44:52(A)(4)(e) says participants who are registered voters give up in-person voting and vote absentee by mail. Certification lasts four years per R.S. 44:52(B)(2). For record confidentiality I quoted the 2025 Justia text of R.S. 46:1844(W)(1)(a) (LA-S19), which still says 'Crime Victims Reparations Board'; Act 684 (LA-S14, page 40) only renames it to the Crime Victims' Compensation Board and leaves the duty unchanged. I did not quote the Act because its extracted text mixes struck words into those lines. Hearings before the board are open to the public unless the board closes them in the victim's interest (R.S. 46:1808(B) as amended), which is worth telling survivors.
