How to check this page

  1. Every rule quotes a saved copy of an official page, word for word. The SHA-256 under each source is the fingerprint of that saved copy, so anyone can confirm the text has not changed.

Minimum loss

MCL 18.354(3)MI-MIN-1

A claim needs at least $200 in out-of-pocket loss or at least 5 days of lost earnings or support; the commission may waive this for victims of criminal sexual conduct in the first, second, or third degree.

An award must not be made on a claim unless the claimant has incurred an out-of-pocket loss of not less than $200.00, or has lost at least 5 days' earnings or support, but the commission may waive the limitations of this subsection if a claimant is retired by reason of age or disability. If the claimant is a victim of criminal sexual conduct in the first, second, or third degree, the commission may waive the limitations of this subsection.

Statute text is from legislature.mi.gov (current through 2022 PA 77 and 78, effective Aug. 12, 2023). The MDHHS SAFE Response page says that for injuries other than the forensic exam, a victim 'would have to' report to police to get compensation, while MCL 18.355a(10) says a forensic exam satisfies prompt reporting and cooperation for payments under section 6, and the MDHHS Do I Qualify page says an exam may be used in lieu of a police report. The statute wins; Tend should rely on MI-REPORT-1. MCL 18.355a(10) also says a survivor cannot be required to participate in the criminal justice system or cooperate with law enforcement to receive a forensic exam. The minimum-loss waiver for criminal sexual conduct is discretionary ('may waive'). Security cap is per residence and crime scene cleanup cap is per crime scene, so params.per uses 'residence' and 'crime_scene', which are not in the schema's per list. The FAQ and brochure say the program does not cover pain and suffering; the forensic exam payment to providers is capped at $1,200 (with up to $700 of that for facility and exam fees) and is separate from the victim's own compensation claim. The federal OVC directory lists the compensation office line as 517-241-7373; the victims-only toll-free line 877-251-7373 is on the MDHHS program page. Reviewer: the saved sources do not say whether the $45,000 aggregate cap and the 2022 PA 77 caps apply to crimes that happened before Aug. 12, 2023 (the agency page says the limit was recently raised from $25,000). MI-CAP-4 (agency table) matches the statutory 35-session and 20-family-session limits in MCL 18.361(6). Filing: the Applying for Compensation page says applications should be submitted electronically when possible, by email (MDHHS-MichiganCrimeVictim@Michigan.gov) or fax (517-335-2439), and can still be mailed; there is no online portal and no in-person drop-off is stated. The application PDF (DCH-0560, Rev. 1-26, MI-S15) is fillable with 202 AcroForm fields and says the previous edition may be used. Required documents come from the English Application Checklist (Revised 02/2025, MI-S18); several apply only to specific benefits (relocation, lost earnings, funeral, loss of support), so each required_document rule carries an expense or note saying when it applies. The checklist also lists two cost estimates and a prescription for rehabilitative equipment if disabled by the injury; that item was not added as a separate rule. ACP: eligibility also requires that the applicant be changing residence (MCL 780.855(2); 'Planning to move' on the AG page) and not be on the sex offender registry; applications must be made with a certified application assistant or victim advocate and include a notarized statement. The AG page's enrollment text says 'with the assistant of' (a typo in the source); the enroll param keeps it as written. MCL 18.363 says the record of a proceeding before the commission is a public record; only the claimant's file and testimony are FOIA-exempt, so Tend should not describe the whole proceeding as confidential.
