How to check this page

Lost wages are capped by regulation at the average weekly wage under the Nebraska Workers' Compensation Act (80 NAC ch. 3, 003.04), but no dollar figure is stated in the saved sources, so no lost_wages expense_cap rule was written. The regulation sets counseling, funeral, crime scene cleanup and direct medical provider limits by an Annual Rate Schedule set by the Committee, which I could not find online; the counseling cap of $5,000 comes from the program's current web page. No source mentions relocation, transportation, or home security as covered expenses. No dollar minimum loss was found; the only threshold is the more-than-seven-consecutive-days rule for wage loss on the application form.

Statute and agency sources disagree in places. (1) Police report window: 81-1821(1)(b) and the Oct 2023 application say five days; the FAQ PDF (updated 4-5-2023) still says three days. Statute wins. (2) Counseling cap: program web page and pamphlet say $5,000; the 2023 FAQ says $2,000; the regulation defers to an unpublished Annual Rate Schedule. Funeral: web page and pamphlet say $10,000, FAQ says $5,000. I used the current web page. (3) Out-of-state crimes: 81-1807(1) lets a Nebraska resident claim for a crime in a state with no program for which they are eligible, but 81-1824 says no order shall be made for offenses occurring outside the state. Left out of rules because of the conflict. (4) 81-1801(8) defines personal injury as actual bodily harm, while the program page describes victims as people physically or emotionally injured; worth a reviewer check for survivors without physical injury. (5) Forensic exam: 81-1429.03(5) lets the Sexual Assault Payment Program pay up to $200 for the examiner fee and $300 for the facility fee, with more payable on documentation; these are provider payment limits, not survivor caps, so they are not encoded. (6) 80 NAC ch. 3, 003.09 says a medical provider that accepts CVR payment accepts it as payment in full and is barred from collecting from the victim (saved in NE-S20). (7) The application requires a U.S. citizenship or qualified alien attestation under Neb. Rev. Stat. 4-108 to 4-114. (8) Regulations were saved from Cornell LII because rules.nebraska.gov is a JavaScript app and the old nebraska.gov PDF links redirect to it. Reviewer (Oct 3): added funeral ($10,000) and crime-scene cleanup ($5,000) caps from the current program page; the regulation (80 NAC ch. 3, 003.06 and 003.08, amended 11/10/2024) sets both by the unpublished Annual Rate Schedule, so these page figures may change.
