You should not be billed for the exam

A physician or hospital that examines a survivor to gather evidence must provide the exam without charge to the survivor. Private insurance is billed only if the survivor chooses to use it.

If a physician or a hospital provides any physical examination of a victim of an alleged sexual offense to gather information and evidence of the alleged crime, these services shall be provided without charge to the individual.

New Hampshire's Address Confidentiality Program, run by the Attorney General, gives survivors of sexual assault, domestic violence, or stalking a substitute address to use on state and local records, with first class mail forwarded to their real address. Survivors apply through a crisis center advocate, and no police report or restraining order is needed.

Any adult person, a parent or guardian acting on behalf of a minor or guardian acting on behalf of an incapacitated person, may apply to the program if they are a victim of domestic violence, sexual assault or stalking and meet the eligibility guidelines.

Statute vs program page: RSA 21-M:8-h, V (most recently amended 2022) sets a $50,000 maximum; the DOJ web page still says $40,000. The rule uses the statute. Reporting: Jus 605.02(c) requires a report within 5 days unless good cause is shown, and the application asks the same; the web FAQ only says to report unless there is a reasonable explanation. Jus 605.13(h) deems a sexual assault survivor who sought the exam or treatment to have reported to law enforcement. Exam billing: RSA 21-M:8-c covers any physical exam of a victim of an alleged sexual offense, while Jus 605.13 uses the words felonious sexual assault. Hospital care: Jus 605.03(e)(2)-(3) bars hospital-care awards for an insured victim unless free or reduced-fee care has been denied. Relocation (Jus 605.07) requires a continuing credible threat and either a police report plus restraining order, or an advocate letter, and the move must happen within 6 months of the award. The program page and Jus 606.07 list different mailing addresses (1 Granite Place South vs 33 Capitol Street); the application form uses 33 Capitol Street. The form's only stated filing method is mail to 33 Capitol Street; the program page's contact block lists 1 Granite Place South, so both are kept as mail rules and a survivor should confirm by phone. The program page lists a fax number and the victimcomp@doj.nh.gov email as contact details only; no source says applications may be filed by fax, email, online, or in person, so no rules were added for those methods. Police reports are not a survivor document: program staff request them from law enforcement (NH-S1, Jus 604.04(b)). Processing: first contact within 2 weeks (program page) and a decision no more than 60 days after a completed application reaches the agenda (Jus 603.03(f)); the program page also says it may take several months or longer. Privacy: the Address Confidentiality Program is created by RSA 7:41 to 7:51 and run by the Attorney General (RSA 7:41 purpose, NH-S7; RSA 7:43 application, sworn statement, and 4-year certification, NH-S8).
