How to check this page

  1. Every rule quotes a saved copy of an official page, word for word. The SHA-256 under each source is the fingerprint of that saved copy, so anyone can confirm the text has not changed.
  2. A checker keeps a rule only if its quote matches the saved text and every number in the rule appears in the quote.
  3. A normalizer turns the rules into the law IR. Rules about someone other than the survivor, or with nothing to compute, are set aside with a reason.

total_cap: Article 22 sets no overall maximum award; it caps specific categories (lost earnings, relocation, property, etc.) and medical and counseling costs have no dollar cap in the statute. I did not record a total cap rather than infer one. Counseling rates: no per-session counseling fee cap was found in Executive Law 631 or in 9 NYCRR 525.3 or 525.12; 525.12(g)(4) lets OVS require proof that counseling is crime-related when a claim is filed more than one year after counseling began. minimum_loss: no minimum out-of-pocket loss requirement was found in the statute sections read. Security: covered for new or enhanced devices with a physician, counselor, or DA statement (525.12(g)(3)); no dollar cap found apart from the $2,500 crime scene securing cap. Financial difficulty: Exec. Law 631(6)(a) requires a finding of financial difficulty except for emergency awards and awards under ten thousand dollars (not a schema category). You should not be billed for the exam

The provider must accept the OVS exam fee as payment in full and may not bill the survivor for the forensic exam services.

Emergency awards

OVS considers whether the victim's own conduct contributed to the injury and can reduce or deny the award on that basis.

the office shall determine whether, because of such victim's conduct, the victim of such crime contributed to the infliction of such victim's injury, and the office shall reduce the amount of the award or reject the claim altogether, in accordance with such determination.

9 NYCRR 525.12(m)(3)NY-CONDUCT-2

Being a victim of sexual assault is a mitigating factor, and OVS may then make the award with no conduct reduction.

However, when considering conduct contributing the office shall examine the following mitigating factors: the victim was a minor, a victim of human trafficking, a sex worker, or a victim of sexual assault. If any such mitigating factors are found in the investigation of the claim pursuant to subdivision (b) of section 525.5 of this part, the office may make an award without reduction for conduct contributing.

Statute text is from the NY Senate Open Legislation site (fetched via Chrome). 9 NYCRR text is from Cornell LII because the official Westlaw NYCRR site is script-heavy; LII shows the 525.12 amendment history through Oct 12, 2022, and its funeral cap ($6,000) is older than the current statute ($12,000 in Exec. Law 631(2)), so for any conflict the statute wins. Effective dates from OVS update pages: three-year filing deadline and Crime Verification Form alternative to police reports apply starting December 31, 2025; filing deadline previously shorter. Exec. Law 631(13)(b) also sets provider reimbursement ceilings for the exam ($800 / $1,200 / $2,500); these are provider rates, not survivor-facing, so I did not encode them. The OVS FRE page says claims received on or after February 3, 2026 are paid by a new OVS fee schedule. PHL 2805-i(1) has two versions of the no-billing paragraph (lettered (d) until May 9, 2027 and (g) after); the quoted text is identical in both. Expense caps with per='item' (clothing, communication items) are per-item limits from 9 NYCRR 525.12(n); per='item' is outside the schema's listed values but is what the regulation says. A phone would most plausibly fall under 'ability to communicate', but the regulation does not name phones. Essential personal property awards for adults generally require a physical injury; sex offense victims are presumed physically injured under Exec. Law 626(1). The older OVS FAQ page and 2022 guideline PDFs state superseded rules (one-week reporting, one-year filing, $500 property cap), so I did not use them. How to file: the English application link on the OVS page (ovs.ny.gov/compensation_application_english) still redirects to the Feb. 2026 fillable PDF saved as NY-S4 (552 AcroForm fields), so that is the newest version. Submission targets come from the application's contact section: mail to the Albany AE Smith Building address and email to OVSIntake@ovs.ny.gov; online filing is through OVS Compass (program.apply_url). The OVS page (NY-S1) also lists a Brooklyn office at 55 Hanson Place for the Compensation Division, but the application says to mail documents to the Albany address, so only Albany is encoded. No fax or in-person filing method is stated. The application also says documents can be sent later if not ready, and the OVS page says OVS may later ask for birth or death certificates, marriage licenses, insurance Explanations of Benefits, and receipts depending on the claim; those on-request items are not encoded as required documents. Photo ID, proof of residency, and wage verification are not requested up front; for lost wages the application says OVS contacts the employer. Address confidentiality: Exec. Law 108 (NY-S21) makes victims of a sexual offense (Penal Law article 130 and 255.25 to 255.27, including threats or attempts) eligible for the Department of State Address Confidentiality Program; applicants affirm they left their residence because of the acts and fear for their safety (108(2)(a)(i)), applications are filed with the office of the secretary (108(2)(c)), designated state, local or nonprofit agencies assist applicants (108(3)), and certification lasts four years (108(2)(e)). The DOS ACP pages (NY-S22, NY-S23) still describe eligibility as victims of domestic violence only and say participation is limited to New York State residents; the statute is broader and wins, so covers_sexual_assault is true from the statute. Law 633(1) (NY-S20) exceptions are legitimate criminal justice requests (where the victim reported to a victim services provider instead of police, OVS may not share identifying information), judicial subpoenas, requests by the victim or claimant or their authorized representative, and purposes necessary for administering Article 22; 633(2) makes other OVS records (such as those under 631-a and 632-a) public; 633(3) keeps records that are confidential under other laws confidential.
