How to check this page

No minimum loss amount was found in SDCL 23A-28B or ARSD 67:55. No relocation or housing benefit was found; lodging is covered only as part of travel for treatment, court, police meetings, or funeral (ARSD 67:55:04:05(9)). Counseling has a time limit in ARSD 67:55:04:03 but no dollar cap was found. No statutory alternative to a police report for sexual assault was found; the 5-day reporting rule in SDCL 23A-28B-25(1) applies, and the application asks for a letter explaining a late report. The exam statute (SDCL 22-22-26.2) does not say whether a survivor's health insurance may be billed for the exam. The dollar limits in ARSD chapter 67:55:04 (security $500, funeral $8,000, homicide scene cleanup $1,500) can be exceeded with commission approval under ARSD 67:55:04:20, but never above the $15,000 statutory cap. No stated processing time for an initial decision was found in the apply page, application, instructions, SDCL 23A-28B, or ARSD 67:55; the only timing found is the 15 business days to send notice of the commission's final decision after an appeal hearing (ARSD 67:55:02:11), which is not an application processing time. No fax number for filing was found (the fax on the application belongs to the DPS civil rights notice). South Dakota has no substitute-address confidentiality program like Safe at Home; the Minnesota Secretary of State's national list also shows South Dakota as having no program. The only option found is the Secretary of State's Secure Active Designation under SDCL 12-4-9.2, which hides the voter registration record only. Eligibility depends on an active protection order (chapter 25-10 or 22-19A) or living in a victims' services shelter, not on the type of crime; the SOS page names rape among the circumstances it is designed for, but no quote says sexual assault survivors are eligible as such, so covers_sexual_assault is false. Forms go to the Office of the Secretary of State, Elections Division, 500 East Capitol Avenue, Suite 204, Pierre, SD 57501. SDCL 23A-28B-36 only keeps records confidential when another law or rule already protects them; it is not a blanket confidentiality rule for claims. SDCL 23A-28B-37 says hearings on an application are open to the public and the hearing record is a public record unless the commission closes the hearing, for example because a public hearing would cause trauma for the victim.

You should not be billed for the exam

Hospitals and clinics must tell survivors the forensic exam is available at no cost to them, and a survivor does not have to take part in the criminal case or cooperate with police to get the exam. The statute does not say whether the survivor's insurance may be billed.

Each hospital and clinic that provides a forensic medical examination under § 22-22-26 shall coordinate with the county to establish a payment process by which the county shall pay for the cost of the examination, and to notify any victim of rape or sexual offense of the availability of an examination at no cost to the victim. A victim of rape or sexual offense is not required to participate in the criminal justice system or to cooperate with law enforcement to be provided with a forensic medical examination.

Lost earnings are paid based on the victim's average monthly earnings for the 6 months before the injury or the monthly minimum wage, whichever is less. The monthly minimum wage is the federal hourly minimum wage times 173.2 hours.

Loss of earnings, loss of future earnings, and loss of support shall be determined on the basis of the victim's average monthly earnings for the six months immediately preceding the date of injury, or the monthly minimum wage as of the date of the crime underlying the claim, whichever is less. The monthly minimum wage shall be based upon the federal hourly minimum wage in effect as of the date of the crime multiplied by 173.2 hours per month.

South Dakota residents hurt by a crime in another state have the same rights as if it happened in South Dakota, but only if that state has no compensation law that covers the injury.

If a resident of South Dakota is a victim of a crime as defined in § 23A-28B-1 , but the crime occurred outside the boundaries of this state, the resident has the same rights under the provisions of this chapter as if the crime had occurred within this state upon a showing that the state, territory, country, or political subdivision of a country in which the crime occurred does not have a crime victims' compensation law which covers the injury or death suffered by the resident.

How the program reviews a claim

An award may be denied if the victim's conduct substantially contributed to the injury, but by statute this does not apply to victims of a sex offense under chapter 22-22, human trafficking, domestic abuse, or child abuse.

Statute text from sdlegislature.gov (codified chapter 23A-28B, and 22-22-26 / 22-22-26.2 as amended by SL 2026, ch 105). Administrative rules are ARSD article 67:55 (still filed under the Department of Social Services title, but the program is now run by the Department of Public Safety); several sections were amended effective September 8, 2026. In the saved text of ARSD 67:55:04:03 the general counseling time window renders as '2 4 months'. The raw HTML of the single-rule page (SD-S9) shows the digits '2' and '4' in adjacent spans with no space, so it reads as 24 months after the crime, but the text check cannot confirm it, so SD-COUNS-1 omits the number. SD-COUNS-2 covers the separate, cleanly stated 24-months-from-application rule for juvenile victims. The primary application PDF is form DPS-VS-694 dated 12/17 and lists an older web address (dps.sd.gov); the program pages now live on sd.gov. The application says lost wages are paid at the federal minimum wage. SDCL 23A-28B-20 sets the monthly minimum wage from the federal hourly minimum wage times 173.2 hours, and pays the lesser of that or the victim's average monthly earnings for the prior six months, so the application is a simplification; the statute controls. ARSD 67:55:01:06 states payment is not allowed for substantial contributory conduct without the sex-offense exception, but SDCL 23A-28B-25(2)(a) exempts sex offense victims and the statute controls. The program page also says it can pay victims of state, tribal, or federal crimes. Awards are payable only to the extent the fund has money (SDCL 23A-28B-10). Reviewer: per-expense dollar limits in ARSD 67:55:04 are not hard caps; the commission may deviate from them (ARSD 67:55:04:20), except for the emergency award and the $15,000 statutory cap. ARSD 67:55:04:13 (2004) requires rape exam bills to go to health insurance before the program pays; it predates the 2018 and 2026 county-pay statute changes and does not say the county may bill the survivor's insurance, so exam_no_bill stays 'unspecified'. Filing info: the saved application PDF (SD-S6, DPS-VS-694 12/17) is the one the current apply page links as the 'Crime Victims' Compensation Application form'; it has no AcroForm fields (pypdf counts 0), so it is a print-and-fill form. The apply page says applicants can mail the form, email a digital copy (its link is mailto:victimsservices@state.sd.us), or apply online through MAVIS; the MAVIS URL comes from the link on the page, not the visible text. The application lists bills, receipts, insurance statements, the signed Declaration and Authorization, the witnessed health information release, and a W-9 as parts of a complete application; the instructions say the W-9 is needed only for final awards over $5,000. The application does not ask for a copy of the police report or a photo ID; the program contacts law enforcement and providers itself. South Dakota has no substitute-address confidentiality program like Safe at Home; the Minnesota Secretary of State's national list also shows South Dakota as having no program. The only option found is the Secretary of State's Secure Active Designation under SDCL 12-4-9.2, which hides the voter registration record only. Eligibility depends on an active protection order (chapter 25-10 or 22-19A) or living in a victims' services shelter, not on the type of crime; the SOS page names rape among the circumstances it is designed for, but no quote says sexual assault survivors are eligible as such, so covers_sexual_assault is false. SDCL 23A-28B-36 only keeps records confidential when another law or rule already protects them; it is not a blanket confidentiality rule for claims. SDCL 23A-28B-37 says hearings on an application are open to the public and the hearing record is a public record unless the commission closes the hearing, for example because a public hearing would cause trauma for the victim.
