The office may reduce or deny an award if the loss could be recouped from other sources, including collateral sources, or if the claim is unreasonable because of the claimant's misconduct.

The office may reduce or deny a compensation award otherwise payable to a claimant if: (i) the economic loss upon which the claim is based has been or could be recouped from other persons, including collateral sources; (ii) the compensation specialist considers the compensation claim unreasonable because of the misconduct of the claimant;

In deciding misconduct, reparations officers may not consider any behavior committed, or perceived to have been committed, by the victim of any sex crime, or behavior under duress, threat, exploitation, or coercion.

When determining whether the victim engaged in misconduct, reparations officers shall not consider: (a) any behavior or action of any victim that is committed by the victim while under the duress or experience of threat, exploitation, coercion or any circumstance absent the victim's own willful desire to participate; or (b) any behavior or action committed or perceived to have been committed by the victim of any sex crime.

Utah recodified the Crime Victim Reparations Act from Title 63M, Chapter 7, Part 5 into Title 75E, Chapter 5 (Chapter 291, 2026 General Session, effective 7/1/2026). R270-1 (effective 12/08/2023, continuation notice March 6, 2026) still cites the old 63M-7 section numbers, and the application PDF still cites 63M-7-519 and 63M-7-510. The rule-based caps (relocation $2,000, transportation $1,000, essential property $1,500/$5,000, emergency $1,000, 25 counseling sessions, 12 weeks lost earnings) come from R270-1 and the board may approve more in extenuating circumstances. The UOVC Code R payment table (UT-S6) lists $625 for an exam and $1250 with photo documentation for dates of service from January 5, 2023; R270-1-24 sets the $1,250 maximum with photo documentation. 75E-5-313(2) also bars medical providers from debt collection while a claim is pending (summarized on the FAQ, UT-S2). Reviewer: R270-1-24(1)(a)'s $1,250 is the examiner fee only (the Code R table, UT-S6, lists $625 without photo documentation), and the facility is paid separately under R270-1-24(2), so it is recorded as exam_payment, not as a survivor-facing expense cap. insurance_billing is set to allowed because the UOVC provider billing page (UT-S4) requires providers to bill all available insurance before UOVC; neither the statute nor R270-1-24 addresses it directly. R270-1-24(3) conditions provider reimbursement on the provider reporting the exam to law enforcement and collecting evidence only with the victim's permission; this is a provider condition, not a survivor reporting requirement. R270-1-8 (abortion) cites 63M-7-511, now 75E-5-309, and is limited to abortions permitted under Title 76, Chapter 7, Part 3. 75E-5-313(1)(b) lets a medical provider (not the exam provider, which R270-1-24(6) covers) collect from the victim up to the office's rate if the office cannot pay in full. How to file (added Oct 3): UOVC moved. The contact page (UT-S9, modified 2026-06-30) and the UOVC homepage list 420 East South Temple, Suite 500, Salt Lake City, UT 84111, while the application PDF (UT-S5, same file as live, created Jan 2025) and the provider billing page (UT-S4) still print 350 East 500 South Suite 200; the submission rule uses the newer contact-page address. Fax 801-533-4127 is the same on both. The online portal URL comes from the apply page's Online Application link, not its visible text. The FAQ (UT-S2) says to send claim correspondence to the program email, which the saved text shows as Cloudflare-obfuscated; the decoded address in the HTML is crimevictims@utah.gov, matching the application, so UT-SUBMIT-2 quotes the application header. The application has 90 AcroForm fields. No in-person submission method is stated. UT-DOC-7 is stored under funeral but the quote covers relocation costs too. Privacy (added Oct 3): UT-ACP-1 quotes the Safe at Home homepage (UT-S11). The statute, now Utah Code Title 75E, Chapter 11 (UT-S16, renumbered from 77-38-601 et seq. by Chapter 291, 2026 General Session), creates the program 'within the department' (75E-11-102(1)), and 75E-1-101(2) (UT-S17) defines the department as the Department of Criminal Justice; the program site carries that department's logo. The statute's definition of victim covers a sexual offense under Title 76, Chapter 5, Part 4, and 75E-11-302 requires a program assistant's recommendation, a relocation within 90 days or an address unknown to the assailant, and does not require a police report or criminal charge. UT-RECCONF-1 quotes 75E-5-205(1); 75E-5-205(6) also requires the office to redact the name of a sexual assault victim and claimant contact information before releasing any restitution record.
