How to check this page

  1. Every rule quotes a saved copy of an official page, word for word. The SHA-256 under each source is the fingerprint of that saved copy, so anyone can confirm the text has not changed.

No emergency or advance award provision was found (the FAQ mentions only that 'Some exceptions may be made for emergency situations' when waiting on insurance or lawsuits). No relocation, temporary housing, or home security expense category was found; 'securing' a crime scene is part of the $1,000 crime scene cleanup cap, not personal security. The FAQ says mileage for appointments and court is not paid; no covered transportation rule was found. No separate cap on the victim's own counseling or lost wages was found beyond the $40,000 total. For compensation claims, the police report rule (5 days, waivable in the interest of justice) has no sexual-assault-specific alternative in the statute or rules; the forensic exam itself is paid by the SAFE Fund with no report required. Address confidentiality: Safe at Home (Wis. Stat. 165.68) is run by the Department of Justice; 165.68(1)(a)3. counts sexual abuse as defined in 103.10(1m)(b)6., which covers violations of s. 940.225 (sexual assault), so covers_sexual_assault is true. Record confidentiality: 949.05(2)(a) shields applicant PII only for claims from listed sexual offenses; 949.16 otherwise says the record of a proceeding is a public record.

You should not be billed for the exam

A health care provider that seeks payment from the state SAFE Fund may not bill the survivor (or the survivor's guardian) for any sexual assault forensic exam costs, and may bill insurance only if the survivor authorizes it.

Who pays for the exam

Where you live and where it happened

The crime must have happened in Wisconsin; any person may apply, so victims who live out of state are not excluded by the statute.

“Crime” means an act committed in this state which would constitute a crime as defined in s. 939.12 if committed by a competent adult who has no legal defense for the act.

A Wisconsin resident hurt outside the state can apply only if the place where it happened has no compensation law covering the injury.

If a Wisconsin resident suffers injury or death in a situation described in s. 949.03 except that the act occurred outside this state, the resident has the same rights under this subchapter as if the act had occurred in this state upon a showing that the state, territory, country or political subdivision of a country in which the act occurred does not have a compensation of victims of crimes law which covers the injury or death suffered by the person.

Statute text is the LRB 2023-24 Wis. Stats. PDF published 10-1-26 (updated through 2025 Wis. Act 247). Jus 11 is the Register November 2024 PDF; its text extraction renders curly quotes and apostrophes as X/Y/[ so quotes from it avoid those characters. The wisdoj.gov SharePoint pages wrap the whole body in a <form>, which the standard fetch tool strips, so WI-S3 to WI-S7 were saved with the same plain HTTP fetch and the same text extraction except that form content is kept; raw HTML and sha256 are the real bytes. Those pages contain zero-width spaces, so quotes were chosen from spans without them. SAFE Fund provider reimbursement is two-thirds of billed eligible services up to $1,200 per exam in Jus 11.16(4), inflation-adjusted yearly; the SAFE Fund page lists the current maximum as $1,621.22. That limit is on the provider's reimbursement, not on the survivor; the no-bill rule in 949.26(2)(a) applies to providers who seek a SAFE Fund award. The SAFE Fund page says it can reimburse when a victim does not want to report, cooperate, or bill insurance. Older DOJ addresses (doj.state.wi.us) still appear on the application PDF; the program phone 800-446-6564 matches the OVC directory and the program page. 949.08(2)(a) bars rather than reduces an award for contributing conduct, and does not apply to people injured aiding victims or police. Reviewer: 949.26(1m) bars a SAFE Fund award when the provider is authorized to bill insurance and the victim cooperates with law enforcement, so the SAFE Fund no-bill rule in 949.26(2) is tied to providers seeking a fund award; a survivor who reports and authorizes insurance billing falls outside it (CVC awards are then reduced by any SAFE award under 949.06(3)(f)). The SAFE Fund pays the provider two-thirds of billed eligible services up to the yearly cap, and the provider may not bill the survivor for the rest. 949.06(4)(a) also says an award may be made whether or not anyone is prosecuted or convicted. How to file: the application page (WI-S5) lists online (recommended) and mail or fax for the paper form. The paper application (WI-S8, DJ-CVC-1 Rev. 10/2024, byte-identical to the live PDF on Oct 3 2026) has no AcroForm fields, so it is print-and-fill only. Its return block also lists Email: ocvs@doj.state.wi.us and the old www.doj.state.wi.us domain; the current pages list ocvs@wisdoj.gov only as a contact address and say paper applications may be mailed or faxed, so no email submission rule was added. The FAQ says nothing has to be sent with the application (bills are optional at filing and the program follows up), and police reports are requested by the program directly from law enforcement, so no police_report document rule was added. No photo ID or proof of residency requirement was found. Processing time is the intake estimate on the program page (90-120 days or longer); no statutory decision deadline was recorded. Privacy (added Oct 3 2026): WI-ACP-1 quotes the DOJ Safe at Home page (WI-S9), saved with the same form-preserving plain HTTP fetch as WI-S3 to WI-S7 because the standard tool strips the SharePoint <form> body; the quote avoids the zero-width spaces on that page. The governing statute is Wis. Stat. 165.68 (WI-S10): eligibility requires Wisconsin residency and being a victim of abuse (or fearing for physical safety), 'Abuse' includes 'Sexual abuse, as defined in s. 103.10 (1m) (b) 6.', and that definition (WI-S11) lists s. 940.225, the sexual assault statute. Participation lasts 5 years and the department may not charge a fee. The enroll text is copied from WI-S9. WI-RECCONF-1 is narrow: 949.05(2)(a) exempts applicant personally identifiable information from public inspection and copying only when the claim arises from s. 940.22(2), 940.225, 948.02, 948.025, 948.051, 948.085, 948.095 or a sexually motivated crime; for other claims 949.16 says 'The record of a proceeding before an examiner or the department under this subchapter is a public record', with records confidential under other law staying confidential. The SAFE Fund has its own rule (949.36): the victim's PII stays confidential when a provider seeks an award unless the victim consents in writing.
