How Tend decides in Colorado

How to check this page

  1. Every rule quotes a saved copy of an official page, word for word. The SHA-256 under each source is the fingerprint of that saved copy, so anyone can confirm the text has not changed.
  2. A checker keeps a rule only if its quote matches the saved text and every number in the rule appears in the quote.
  3. A normalizer turns the rules into the law IR. Rules about someone other than the survivor, or with nothing to compute, are set aside with a reason.
  4. The compiler turns the IR into bytecode. The listing below is that bytecode, with each block commented with the rule it came from. The same image runs on the server and in the browser.

No statewide per-expense caps (counseling, lost wages, relocation, transportation, medical, security) were found; each judicial district board sets its own limits by policy, and the state application says some districts do not pay up to the $30,000 statutory limit. Filing deadline: after SB 24-120 (2024), C.R.S. 24-4.1-108(1)(f) only requires that the application be filed with the board and states no time limit for injury claims; property damage claims must be filed within six months (24-4.1-108(1.5)(d)), which the schema cannot express in years or days. No minimum loss amount appears in the statute. Whether insurance may be billed for the evidence-collection portion of the exam is not stated in the statute. How to file: Colorado has no single statewide submission address; the DCJ pages say to send the application to the administrator in the judicial district where the crime occurred, so the submission rule points there and the district addresses and emails are on CO-S1. The 2016 form's insurance section is information to fill in, not a separate document. Address confidentiality: Colorado's ACP is run by the Department of Personnel & Administration (Division of Central Services), not the Secretary of State; the statute (C.R.S. 24-30-2104, CO-S18) covers relocated victims of domestic violence, a sexual offense, human trafficking, or stalking. Record confidentiality: C.R.S. 24-4.1-107.5(2) makes compensation claim materials confidential, with narrow court-review and in camera exceptions.

You should not be billed for the exam

C.R.S. 18-3-407.5(3)(b)CO-EXAM-1

A sexual assault survivor does not pay for the evidence-collection forensic medical exam, even if they do not want to take part in the criminal justice process or cooperate with law enforcement. The DCJ SAVE page reads this as the evidence-collection portion of the exam; other exam-related medical costs go through SAVE or Victim Compensation, not this rule.

A victim of a sexual offense shall not bear the cost of a forensic medical examination that includes the collection of evidence that is used for the purpose of evidence collection even if the victim does not want to participate in the criminal justice system or otherwise cooperate with the law enforcement agency, prosecuting officer, or other government official.

Who pays for the exam

The program must cover medical fees and costs associated with obtaining the medical forensic examination, including but not limited to emergency department fees and costs, laboratory fees, prescription medication, and physician's fees, as long as funds are available.

The DCJ SAVE page states a per-incident cap of $4,000 for FY 2026, covering the exam and related medical costs, for survivors who make a medical or anonymous report. The cap can change with available funds. Colorado's FY 2026 ended in June, and the page as retrieved in October still showed this figure, so the cap for the current year should be confirmed with DCJ.

For FY (fiscal year) 2026, the current per incident cap payable by the SAVE program is $4,000.

Law enforcement must be notified, but documentation that a forensic exam was done by a licensed or registered nurse or medical provider satisfies this requirement. The board may also waive it in the interest of justice.

Emergency awards

C.R.S. 24-4.1-112(1)CO-EMERG-1

A local board may approve an emergency payment before the final decision if waiting would cause undue hardship; the amount follows each board's policy and is deducted from the final award.

The board may order an emergency approval to the applicant pending a final decision in the claim if it appears to the board, prior to taking action upon the claim, that undue hardship will result to the applicant if immediate payment is not made.

Statute text was taken from Justia (marked 2025), which includes the SB 24-120 amendments effective May 15, 2024; 2026 session changes, if any, were not checked. Colorado's program is decentralized: claims go to the board in the judicial district where the crime occurred, and boards may waive requirements or reduce awards (24-4.1-108(2)). The DCJ-linked state application PDF is dated 2016 and still lists a one-year filing deadline and 72-hour police notification for all claims; current statute keeps the 72-hour rule only for property damage claims (24-4.1-108(1.5)(b)) and has no deadline for injury claims, so the form's deadline was not used. Some local district pages also still state a one-year deadline; survivors should apply promptly and confirm with their district. 'Injury' includes mental impairment and pregnancy (24-4.1-102(8)). Forensic exam payment: law enforcement pays when the survivor reports; DCJ pays when the survivor does not take part (18-3-407.5); SAVE (18-3-407.7) covers related medical costs for medical and anonymous reporters, with an FY2026 cap of $4,000 per incident per the DCJ SAVE page.
