How to check this page

Statute text is from the official Delaware Code Online. Counseling: the only counseling limits found are $1,200 per child victim for psychological assessment and short-term counseling under the Child Victim Counseling and Assessment Program (1 Del. Admin. Code 301-26.0, 11 Del. C. § 9024) and a 50-session limit that applies only to reopened claims under § 9009(13); neither is encoded as a general counseling cap. Medical, mental health, and dental providers paid by VCAP must accept the VCAP payment as payment in full and may not bill the victim the balance (Rules 28.1, 29.1, 30.1); VCAP pays 80% of usual and customary charges (Rules 28.2, 29.2, 30.2). The printable application PDF is an image scan with no extractable text, so no rules were drawn from it. No separate SANE or forensic exam payment policy beyond 11 Del. C. § 9023 was located.

You should not be billed for the exam

Hospitals and health care professionals must give sexual offense forensic medical exams free of charge, and the survivor pays no out-of-pocket cost and does not have to file a compensation application for the exam. The provider bills the patient's insurance first.

The victim of the sexual offense shall not pay any out-of-pocket costs associated with the forensic medical examination and shall not be required to file an application with the Agency.

Any hospital or health-care professional performing a forensic medical examination shall seek reimbursement for the examination from the patient's insurance carrier, including Medicaid and Medicare, if available. Limits on a kind of cost

11 Del. C. § 9013DE-CAP-6

If the claimant has a lawyer before the Appeals Board, the Board may award attorney fees of up to $1,000 or 15% of the award, whichever is less, paid on top of the compensation. The lawyer may not charge the claimant anything beyond that award.

Such fees shall not exceed $1,000 or 15% of the amount awarded, whichever sum is less, and shall be in addition to the amount of compensation awarded to the claimant.

Insurance and other payments come first

Reporting to police

11 Del. C. § 9010(a)(5)DE-REPORT-1

The crime must be reported to law enforcement within 72 hours, but this is waived if it was reported to protective services or Family Court, the victim has a protection from abuse order, the victim cooperated with law enforcement or an appropriate government agency in a sexual assault case, or the Agency finds the requirement unreasonable.

Where the victim has failed to report the crime to a law-enforcement agency within 72 hours of its occurrence. This requirement is waived in any of the following circumstances: a. The crime has been reported to an appropriate governmental agency, such as child or adult protective services or the Family Court. b. The victim can provide a protection from abuse order. c. The victim has cooperated with law enforcement or an appropriate government agency in cases of crimes involving domestic violence, sexual assault or abuse. d. Where the Agency, in its discretion, determines that the circumstances of the crime or the victim render this requirement unreasonable.

A Delaware domiciliary hurt by a crime in another state may apply if the crime would be compensable in Delaware and that state has no eligible program with equal benefits.

A person whose domicile is in Delaware and who is the victim or secondary victim of a crime that occurs in another state, possession, or territory of the United States may make an application for compensation if both of the following are true: a. The crimes would be compensable had they occurred in Delaware. b. How the program reviews a claim

If the victim bears a share of responsibility for the injury, the Agency reduces the award by that share.

Sources disagree in a few places and the statute controls: (1) the regulation sets the funeral and burial cap at $5,000 (Rule 25.0) while 11 Del. C. § 9002(10)s. sets $7,500; funeral is not encoded. (2) The program FAQ states the 72-hour police report requirement without exceptions, but § 9010(a)(5) waives it for, among other things, a protection from abuse order or cooperation with law enforcement or an appropriate government agency in sexual assault cases. (3) Rule 13.2 says reconsideration must be requested within 15 days; § 9012(b) says 30 days. (4) The statute measures the filing deadline from the personal injury and Rule 11.1 from the date of the crime; for sexual assault these are normally the same day. Additional sexual-assault-specific provisions: § 9009(11) lets a victim of a crime that occurred before age 18 claim counseling up to the 20th birthday, and that age limit does not apply to sexual assault or abuse; § 9009(12) bars statute of limitations limits on claims from child sexual assault or abuse; § 9010(d) bars denial solely because a child sexual assault victim delayed reporting or applying. Forensic exam payment flows provider to insurance to the fund under § 9023, so insurance_billing is recorded as allowed (the provider must bill insurance) while the survivor owes nothing out of pocket.
