How to check this page

Filing deadline and police report rule: 2024 Ky. Acts ch. 67 (SB 319, effective July 15, 2024) deleted the old five-year filing limit from KRS 49.330 and the old 48-hour report rule. The current KRS 49.330 and 49.370 text sets no general filing deadline and no reporting deadline, so no filing_deadline or reporting_requirement rule is recorded. The CVCB FAQ (updated August 2024) still lists a police report of the incident among the documents generally required with a claim, and the claim form asks when and to whom the crime was reported, so a survivor should expect to be asked for one; the program brochure says the sexual assault exam program does not require reporting. No minimum loss amount was found. The program's HTML pages (static_id=158 and 159) could not be saved because the fetch tool strips their ASP.NET form content; their PDFs were saved instead.

You should not be billed for the exam

KRS 216B.400(10)(a)KY-EXAM-1

When a sexual assault exam is given, no hospital, exam facility, clinician, pharmacist, health department, the survivor's insurer, or the state may charge the survivor for the exam, even if the exam is not completed.

When an examination of a victim of a sexual offense is provided in accordance with this section, no charge shall be made to the victim by the hospital, the sexual assault examination facility, the physician, the pharmacist, the health department, the sexual assault nurse examiner, other qualified medical professional, the victim's insurance carrier, or the Commonwealth for: (a) Sexual assault examinations, whether or not the exam is completed;

Insurance and other payments come first

Awards are reduced by money received or to be received from the offender, required insurance, public funds, the claimant's own insurance, an emergency award, or donations toward crime expenses.

Any award made pursuant to KRS 49.270 to 49.490 shall be reduced by the amount of any payments received or to be received by the claimant as a result of the injury from the following sources: (a) From or on behalf of the person who committed the crime; (b) Under insurance programs mandated by law; (c) From public funds; (d) Under any contract of insurance wherein the claimant is the insured or beneficiary; (e) As an emergency award pursuant to KRS 49.360; and (f) From donations made on behalf of the victim or claimant toward expenses incurred as a result of the crime.

Address confidentiality program

Kentucky's Safe at Home Program, run by the Secretary of State, protects victims of sexual assault, rape, other sexual crimes, domestic violence, human trafficking, and stalking by letting them use a designated address instead of their real one. It also covers their minor children and anyone living with them, and it is free for Kentucky residents who are U.S. citizens.

The Safe at Home Program shall be operated with the intent to protect victims of: (a) Domestic violence; (b) Human trafficking; (c) Stalking; (d) Sexual assault; (e) Rape; and (f) Other sexual crimes as defined by KRS 17.500. The Safe at Home Program shall authorize the use of designated addresses for victims, their minor children, and all other individuals residing with the victim.

A survivor seeking the lump sum for a sexual assault claim filed more than ten years after the crime must send proof of the crime date, that the kit was collected and when, that it went untested for a long time, and anecdotal proof of damages.

Nonresidents who suffer losses from crimes in Kentucky are covered during periods when the board finds federal funds are available.

"Victim" shall also include nonresidents of this state who suffer losses as a direct result of criminal acts occurring within this state. This section shall be operative only during those time periods during which the Crime Victims Compensation Board determines that federal funds are available to the state for the compensation of victims of crime.

How the program reviews a claim

KRS 49.390(2)KY-CONDUCT

The board may deny, reconsider, or reduce an award if the victim or claimant was charged with an offense, was offered immunity, knowingly took part in the conduct, or engaged in mutual aggression, in relation to the crime in the claim.

The board may deny, reconsider, or reduce an award if the board finds that, in relation to the criminally injurious conduct alleged in the claim, the victim or claimant: (a) Has been charged with a criminal offense; (b) Has been offered immunity from prosecution in exchange for testimony; (c) Knowingly participated in the conduct; or (d) Engaged in conduct which may constitute mutual aggression with another person.
