A Virginia resident hurt by a crime outside Virginia can qualify only if they would be eligible had it happened in Virginia and the place where it happened has no eligible compensation program that pays nonresidents.

A resident of Virginia who is the victim of a crime occurring outside Virginia and any other person as defined in subsection A who is injured as a result of a crime occurring outside Virginia shall be eligible for an award pursuant to this chapter if (i) the person would be eligible for benefits had the crime occurred in Virginia and (ii) the state, country or territory in which the crime occurred does not have a crime victims' compensation program deemed eligible pursuant to the provisions of the federal Victims of Crime Act and does not compensate nonresidents.

Statute text retrieved Oct 3 2026 reflects 2025 and 2026 amendments: total cap $35,000 (§ 19.2-368.11:1(H)) and a three-year filing deadline (§ 19.2-368.5(B)). VVF pages say the three-year deadline applies to crimes on or after July 1, 2025 and that caps follow the policy in effect on the date of the crime, so older crimes may fall under a one-year deadline and older caps. Disagreement: the statute caps survivor counseling for family of homicide victims at $3,500 per claim (§ 19.2-368.11:1(E)(v)), while the VVF eligibility page and claim form list grief counseling up to $5,000; neither cap applies to direct sexual assault victims, so no counseling cap was recorded. Disagreement: the VVF Policies PDF says only victims of child sexual assault are exempt from prompt reporting, but the current § 19.2-368.10(3) says the reporting subdivision does not apply to claims of sexual abuse, which § 19.2-368.2 defines to include adult rape, sodomy, object sexual penetration and sexual battery; the statute controls. For other crimes, prompt reporting is judged from police records, the victim's situation, and any permanent protective order (§ 19.2-368.10(3)); the claim form says crimes between July 1, 1998 and June 30, 2025 used a 120-hour reporting standard with good cause.
