No minimum loss amount appears in the statute or program pages (the old eligibility page only says there must be an economic loss). No emergency or advance award provision was found in W. Va. Code 14-2A. No dollar cap for the victim's own counseling, lost wages or medical care was found beyond the $35,000 total; the only counseling cap found is $5,000 for secondary victims (14-2A-3(a)(5)), which is not encoded as a rule because it does not apply to the survivor. Security devices and temporary housing are not listed as allowable expenses. The program may set maximum rates for health care services by rule or order (14-2A-19b), but no rate schedule was found. Record confidentiality is limited: 14-2A-11a(b) makes Fund records confidential only for claims filed on behalf of a minor child who is the subject of a civil abuse and neglect petition; nothing in 14-2A, the program's procedural rules, or the program pages makes an adult survivor's claim confidential.

Reporting to police

Nothing in this section shall be construed to require an alleged victim of sexual assault to participate in the criminal justice system or to cooperate with law enforcement in order to be provided a forensic medical examination pursuant to the provisions of this section.

The crime must be reported to law enforcement within 96 hours, but for a sexual offense a forensic medical exam within 96 hours meets the requirement instead. Good cause can excuse a late report or exam, and juvenile victims are exempt.

The commissioner may not approve an award of compensation if the criminally injurious conduct upon which the claim is based was not reported to a law-enforcement officer or agency or, in the case of sexual offense, the victim did not undergo a forensic medical examination, within 96 hours after the occurrence of the conduct, unless it is determined that good cause existed for the failure to report the conduct or undergo a forensic medical examination within the 96-hour period: Provided , That reporting to a law-enforcement officer or agency or a forensic medical examination is not required if the victim is a juvenile in order for a commissioner to approve an award of compensation

Beyond the police report, a criminal charge generally has to be filed. It is not required when the offender is unknown, when the claimant was a juvenile, or when an adult claimant did not cause the lack of charges and law enforcement confirms the evidence supports that a crime occurred. A conviction is not required.

The filing of a criminal charge shall be a prerequisite for receipt of compensation unless it is determined that no charges were filed due to the identity of the perpetrator being unknown: Provided, That no criminal charges need be filed if: (1) The claimant is an adult at the time the conduct giving rise to the claim occurred and no criminal charges were filed for reasons other than the desire of the claimant and a law-enforcement agency confirms that the available evidence supports a finding that a crime occurred; or (2) the claimant was a juvenile at the time the conduct giving rise to the claim occurred.

Where you live and where it happened

The crime must occur in West Virginia, or in a state without a victim compensation program. A nonresident is eligible only if the crime happened in West Virginia, and West Virginia residents are also covered for crimes outside the United States.

“Criminally injurious conduct” means conduct that occurs or is attempted in this state, or in any state not having a victim compensation program, which poses a substantial threat of personal injury or death and is punishable by fine or imprisonment. “Criminally injurious conduct” also includes criminally injurious conduct committed outside of the United States against a resident of this state.

Statutes were read from code.wvlegislature.gov on 2026-10-03 (14-2A-3 shows 2025 amendments). Program pages disagree with the statute in places, and the statute is used: (1) the older eligibility page at wvlegislature.gov/Joint/Victims/eligibility.cfm and the application packet say a report within 72 hours, while 14-2A-14(b) now says 96 hours and accepts a forensic exam for sexual offenses; the newer victims.wvlegislature.gov eligibility page matches the statute. (2) Program pages list funeral costs up to $7,000 or $10,000; the statute says $10,000 (not encoded since it only applies to death claims). (3) Both eligibility pages say a minor victim must file before the 20th birthday, but 14-2A-10(b) as read only states two years from the crime, so the minor rule is not encoded. Other notes: 14-2A-18 makes the filing of criminal charges a prerequisite with exceptions (unknown offender, juvenile claimant, or adult who did not block charges where law enforcement confirms a crime occurred). 14-2A-19b says a provider that accepts the commission's payment must take it as payment in full and may not bill the claimant the difference. Program Rule 12 says the commission pays medical providers 50% of outstanding balances after collateral sources as payment in full, with no reduction against the claimant. 14-2A-14(g)(2) allows up to $100,000 more for special needs when the injury leaves the victim disabled under the Social Security Act. Claims close 10 years after filing or when benefits run out (14-2A-14a). Toll-free number 1-877-562-6878 (within West Virginia) is on WV-S8. A secondary eligibility page lists (304) 347-4851, which looks like a typo; the phone uses 304-347-4850 from the home page and the OVC directory. Reviewer: 14-2A-14(a) opens with "Except as provided in §14-2A-10(b)", which hints at an exception to the two-year limit, but the saved 14-2A-10(b) (last amended 2017) states no exception; the program's minor-victim rule (file before the 20th birthday) could not be tied to statute text and stays out of the rules. WV-REP-2 is a criminal-charge requirement (14-2A-18), stricter than a police report; the engine should not treat it as satisfied by a forensic exam. The court-travel cap in WV-CAP-3 does not apply to medical travel. How to file (added 2026-10-03): the application PDF (WV-S11, last modified 2016 and still the file linked from the program home page) is a flat, non-fillable form with 0 AcroForm fields, so it is printed and filled by hand. Its cover page says to mail it to the Fund; the home page (WV-S8) also links an online claim form (WV-S12, saved directly because the page text is short and the fetch tool's length check flagged it). The packet and home page list a fax number (304-347-4915) and email (cvictims@wvlegislature.gov) as contact details only, never as ways to file, so no fax or email submission rule is encoded; because the release must be notarized, the survivor should mail the original. Rule 4 says the application is filed in duplicate while the packet does not mention copies; WV-DOC-4 records the rule. Death-claim documents (death certificate, funeral bills, guardianship papers) are listed on the form but not encoded since they do not apply to a surviving victim. Processing times come from the procedural rules (6 months for the investigator's finding, then a 30-day response window, then 45 days for the Commissioner's opinion); no program page gives an overall decision or payment time. The victims.wvlegislature.gov application link (/crime-victims-compensation-application/) returned 404 on 2026-10-03. Privacy (added 2026-10-03): The Address Confidentiality Program is run by the Secretary of State under W. Va. Code 48-28A. 48-28A-101 (WV-S14) names victims of sexual assault, and the SOS page (WV-S16) lists sexual assault among eligibility grounds; it also requires having relocated within 30 days or planning to relocate, no government records at the new address, West Virginia residency, and age 18 or a parent or guardian applying for a minor. 48-28A-103 (WV-S15) says applications go through an application assistant and certification lasts four years. The ACP contact line (866) 767-8683 and acp@wvsos.gov are on WV-S16. For compensation records, I read every section of 14-2A on code.wvlegislature.gov. The only confidentiality provision is 14-2A-11a(b), which covers claims for a minor child in a civil abuse and neglect case (WV-RECCONF-1 is scoped to that). 14-2A-12(c) lets a court issue protective orders over police and prosecutor records the claim investigator requests, which protects witnesses but does not make the claim itself confidential, so it is not encoded. 14-2A-21 requires an annual public report listing the amount of each award. The engine should not tell an adult survivor in West Virginia that the claim file is confidential by law.
